Terms of use
These terms govern your use of the Marktek website and its apps platform. Read them carefully: using the website or the platform means you accept them.

1.Accepting the terms
By using the website or creating an account on the platform, you accept these terms and the privacy policy. If you use the platform for a company, you confirm that you may accept the terms on its behalf. If you do not accept them, do not use the service.
2.The service
Marktek offers businesses an apps platform for customer relationships, contacts, WhatsApp marketing, email marketing, surveys, employees and calendar, besides marketing and consulting services. The website content is general information, not a binding offer. The free introductory session creates no contractual obligation for either side.
3.Accounts and their security
You give accurate details when you register, keep your password and verification codes secret, and tell us at once about any unauthorized use. The owner of a company account is responsible for inviting its members, setting their permissions, and everything done through the company's accounts.
4.Subscriptions, trials and payment
Your plan sets the available apps, the usage limits and the price, as shown on the pricing page or in your offer. We may offer a trial that ends on its date unless you subscribe. Fees are paid in advance for each period and are not refunded for a period that has started, unless the law says otherwise. If we change a plan's price, we tell you before the change applies to your subscription.
5.Acceptable use
Do not send messages through the platform to anyone who has not agreed to receive them, nor spam or misleading messages, and respect unsubscribe requests. Follow Meta's WhatsApp policies and the commercial messaging and data protection laws of your country. Do not use the platform for anything unlawful, and do not try to break into it, disrupt it, or reach another company's data.
6.Your company's data
The data your company enters belongs to it, and the company is responsible for collecting it lawfully and for the consent of the people it concerns. We process it on the company's behalf only to provide the service, as the privacy policy describes. You can export your data at any time while the subscription is active.
7.Service availability
We work to keep the platform available at all times and take regular backups, but we do not guarantee it will be free of interruptions or errors. We may pause it for maintenance or updates, and tell you in advance whenever we can.
8.Intellectual property
The Marktek name and logo, and the content and software of the website and the platform, belong to Marktek. Your subscription gives you the right to use the platform during its term only, without the right to copy, sell or redistribute it. Names of other services, such as WhatsApp, are trademarks of their owners.
9.Third-party services
Some features work through third-party services, such as WhatsApp from Meta and Brevo for email. Their use is also subject to those services' terms, and we are not responsible for their outages, changes to their terms, or their rejection of a message or template.
10.Suspension and termination
You can cancel your subscription at any time, and it stays active until the end of the paid period. We may suspend or end an account that breaks these terms or whose fees are unpaid, after telling you whenever we can. After termination you have a reasonable time to export your data before it is deleted.
11.Limitation of liability
The service is provided as is and as available. As far as the law allows, Marktek is not liable for indirect damages, lost profits, or data lost through misuse. Its total liability never exceeds the fees you paid in the twelve months before the claim.
12.Governing law
These terms are governed by the laws of the Republic of Türkiye. We first seek to settle any dispute amicably, and if that fails, the courts of Istanbul have jurisdiction.
13.Changes to the terms
We may change these terms. We publish the new version here with its date, and tell account holders by email before any significant change takes effect. Continuing to use the service after it applies means you accept it.
